1. Acceptance of Terms

By accessing and using Momentia ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

Momentia provides an event photo collection platform that allows event organizers to:

Create event pages with unique QR codes
Collect photos from event guests
Organize and display event photos in galleries
Download collected photos
Share event pages with guests

3. User Accounts

Account Creation: You must provide accurate and complete information when creating an account.

Account Security: You are responsible for maintaining the confidentiality of your account credentials.

Account Termination: We reserve the right to suspend or terminate accounts that violate these terms.

4. Pricing and Payment

Plans: We offer three pricing tiers:

Basic Plan: ₱499 (50 photos, 30 days)
Standard Plan: ₱999 (200 photos, 60 days)
Premium Plan: ₱1,499 (1,000 photos, 90 days)

Payment Processing: Payments are processed via GCash. Payment confirmation is required before event activation.

Refunds: Refunds may be issued at our discretion for unused services within 7 days of payment.

5. Content and Usage Rights

User Content: You retain all rights to photos and content you upload to Momentia.

License to Momentia: By uploading content, you grant Momentia a limited license to store, display, and process your content solely for providing the service.

Prohibited Content: You may not upload content that is illegal, offensive, pornographic, defamatory, or violates intellectual property rights.

6. Acceptable Use

You agree NOT to:

Use the service for any illegal purpose
Upload malicious code or viruses
Attempt to gain unauthorized access to our systems
Harass, abuse, or harm other users
Scrape or copy content without permission
Resell or redistribute our service

7. Service Availability

We strive to maintain 99% uptime but do not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue any part of the service with or without notice.

8. Data Storage and Deletion

Storage Period: Photos are stored for the duration of your selected plan (30, 60, or 90 days).

Data Deletion: After your plan expires, we will delete all event photos within 7 days unless you renew.

Download Backup: You are responsible for downloading and backing up your photos before expiration.

9. Limitation of Liability

Momentia is provided "as is" without warranties of any kind. We are not liable for any damages arising from use of the service, including but not limited to lost data, lost profits, or business interruption. Our total liability is limited to the amount you paid for the service.

10. Philippine Law and Jurisdiction

These terms are governed by the laws of the Republic of the Philippines. Any disputes shall be resolved in the courts of the Philippines.

11. Changes to Terms

We may update these terms at any time. Continued use of the service after changes constitutes acceptance of the new terms. Material changes will be notified via email.
